Please read these Terms of Service carefully before using FestivPlanner. By creating an account or using the Service, you agree to be legally bound by these Terms. These Terms constitute a binding agreement between you and the operators of FestivPlanner.

1. Acceptance of Terms

By accessing or using FestivPlanner ("the Service", "we", "us", "our"), you confirm that you are at least 13 years of age and agree to be bound by these Terms of Service ("Terms"). If you are under 18, you represent that you have obtained parental or guardian consent. If you do not agree to these Terms in full, you must not use the Service.

2. Description of Service

FestivPlanner is a web application that allows users to browse festival lineups, build personal schedules, detect scheduling conflicts, coordinate festival attendance with groups, and receive related notifications via a connected Discord bot. Festival lineup data is sourced from third-party providers (including Clashfinder) and user submissions. We do not produce, organise, or affiliate with any festival or artist.

3. Accounts and Authentication

You may create an account using third-party authentication providers (such as Google or GitHub) managed by Clerk. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to (a) provide accurate registration information, (b) notify us immediately of any unauthorised access to your account, and (c) not share your account with any other person. We reserve the right to terminate accounts that violate these Terms.

4. User Conduct

You agree not to: (a) use the Service for any unlawful purpose or in violation of any applicable laws; (b) scrape, crawl, or otherwise extract data from the Service by automated means without prior written permission; (c) attempt to gain unauthorised access to any part of the Service, its servers, or any connected systems; (d) upload, transmit, or share content that is defamatory, obscene, abusive, or infringes any third-party rights; (e) impersonate any person or entity; (f) interfere with or disrupt the integrity or performance of the Service; or (g) use the Service to send unsolicited communications.

5. User-Submitted Content

When you submit festival information ("User Content"), you grant FestivPlanner a non-exclusive, worldwide, royalty-free licence to display, distribute, and modify that content within the Service. You represent that you have the right to submit such content and that it does not infringe any third-party rights. We reserve the right to review, reject, or remove any User Content at our sole discretion. All submitted festivals are subject to moderation and approval before becoming publicly visible.

6. Accuracy of Data

Festival lineup data (set times, stage assignments, artist details) is sourced from third-party providers and user submissions. We make no guarantee of accuracy, completeness, or timeliness of this data. Lineups are subject to change without notice at the discretion of festival organisers. You should independently verify all schedule information before making travel or ticketing decisions. FestivPlanner is not responsible for any loss or inconvenience arising from inaccurate or outdated data.

7. Groups and Collaboration

The Service enables users to create and join groups to coordinate festival attendance. Group owners are responsible for managing membership and complying with these Terms. By joining a group, you consent to other group members viewing your submitted picks for the relevant festival. Group schedule data is derived algorithmically from member picks and is provided for planning purposes only.

8. Discord Integration

Certain features require linking your FestivPlanner account to a Discord account and inviting our bot to a Discord server. By enabling this integration, you agree to Discord's Terms of Service and Privacy Policy in addition to ours. You can unlink your Discord account at any time through Settings. We are not responsible for any actions taken by the Discord platform.

9. Intellectual Property

All intellectual property rights in the Service, including its design, code, branding, and original content, are owned by or licensed to FestivPlanner. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended personal, non-commercial purpose. Nothing in these Terms transfers any ownership rights to you. Artist names, images, and other third-party trademarks displayed on the platform remain the property of their respective owners.

10. Third-Party Services

The Service integrates with and relies upon third-party providers including Clerk (authentication), Supabase (database), Clashfinder (festival data), Spotify (artist enrichment), and Discord (bot notifications). Your use of these integrations is also subject to the terms and policies of those providers. We are not responsible for the availability, accuracy, or conduct of any third-party service.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FESTIVPLANNER AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED £50 (FIFTY POUNDS STERLING).

13. Indemnification

You agree to indemnify, defend, and hold harmless FestivPlanner and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party right.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 9, 11, 12, and 13) shall survive.

15. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last Updated" date at the bottom of this page. If changes are material, we will provide notice via email or a prominent in-app notification. Your continued use of the Service after any revision constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
